In the case York v. Jones (1989), the United States District Court for the Eastern District of Virginia was one of the first US courts to address a dispute over a cryopreserved preembryo. Steven York and Risa Adler-York (the Yorks), a married couple, provided their gametes to doctors who created the preembryo, which the court referred to as a pre-zygote, as part of an in vitro fertilization (IVF) program at the Howard and Georgeanna Jones Institute for Reproductive Medicine (Jones Institute) in Norfolk, Virginia. The couple sued when the doctors at the Jones Institute refused to release the preembryo to the Yorks for use at a different IVF clinic. The Virginia district court denied the Jones Institute's attempt to have the York v. Jones case dismissed, and instead upheld the Yorks' right to move forward with their lawsuit. The York v. Jones decision had important implications for future disputes over cryopreserved preembryos because it treated the Yorks' cryopreserved preembryo as legal property over which the Yorks retained decision-making authority.

In the United States, the Code of Federal Regulations Title 45: Public Welfare, part 46 (45 CFR 46) provides protection for human subjects in research carried out or supported by most federal departments and agencies. 45 CFR 46 created a common federal policy for the protection of such human subjects that was accepted by the Office of Science and Technology Policy and issued by each of the departments and agencies listed in the document. The code is divided into four subparts: basic protection applicable to all human research subjects; additional protections for women, human fetuses, and neonates; additional protections for prisoners; and additional protections for children. Although 45 CFR 46 contains additional protections for human fetuses, it is important to note that these protections last only from implantation to birth, and are not extended to embryos before implantation.

To Lynn M. Morgan, the Mary E. Woolley Professor of Anthropology at Mt. Holyoke College, nothing says life more than a dead embryo. In her easily readable book, Icons of Life: A Cultural History of Human Embryos, Morgan brings together cultural phenomena, ethics, and embryology to show that even dead embryos and fetuses have their own stories to tell. As an anthropologist, Morgan is interested in many things, including the science of embryology and its history. But she also wants to know how culture influences our views on embryos and the material practices that accompany their study. Her intent is to establish a relationship between specimens collected in the remote past and the contemporary cultural politics of abortion (p. xiii). The eight chapters in Icons of Life do not provide an exhaustive historical look at early American embryology, but they do weave together the Carnegie Institute of Washington Embryology Department (CIWED), its major human embryo collector Franklin Paine Mall, and how early twentieth-century science worked. Morgan ably describes the CIWEDÕs early foray into embryo collecting, but she wants to do more than just describe how embryos made their way to the laboratory. She wants us to ask why it was even possible for such a thing to happen without so much as a fuss being made from the public. This involves looking at culture.

In 1830, a dispute erupted in the halls of lÕAcad mie des Sciences in Paris between the two most prominent anatomists of the nineteenth century. Georges Cuvier and tienne Geoffroy Saint-Hilaire, once friends and colleagues at the Paris Museum, became arch rivals after this historical episode. Like many important disputes in the history of science, this debate echoes several points of contrasts between the two thinkers. The two French Ânaturalists not only disagreed about what sorts of comparisons between vertebrates were acceptable, but also about which principles ought to underlie a rational system of animal taxonomy and guide the study of animal anatomy. Digging deeper into their differences, their particular disagreements over specific issues within zoology and anatomy culminated in the articulation of two competing and divergent philosophical views on the aims and methods of the life sciences. The emergence of these two distinct positions has had a lasting impact in the development of evolutionary and developmental biology. This essay will provide an overview of the conceptual themes of the debate, its implications for the development of the life sciences, and its role in the history of embryology and developmental biology.

Widely known as a key contributor to the Roman Catholic Church's body of doctrine, St. Thomas Aquinas also published an opinion on the moral status of embryos and fetuses that seems contradictory to the Catholic Church's current standpoint on the matter. Born in Naples, Italy, around 1225 (scholars debate the exact year of many of his life events) to wealthy nobility, Thomas Aquinas quickly proved himself a pious and astute scholar with an insatiable desire for logic and understanding. After receiving his formative education in Montecassino and Naples, Italy, Aquinas joined the order of the Dominicans. His desire for the holy life shocked and upset his family, who lamented his choice of a poor lifestyle devoted to service. To prevent Aquinas from following through with his plan, his family held him captive in the San Giovanni fortress in Rocca Secca, Italy, for nearly two years. After his mother and siblings noted his devotion to the Church evidenced by his daily studies and constant writing (not to mention his dismissal of concubines), they relented and allowed him to take his vows with the Dominicans around 1245. It is also estimated that he officially received his Master's in the Arts from the University of Naples around this time.

Victor Albrecht von Haller was an 18th century scientist who did extensive work in the life sciences, including anatomy and physiology, botany, and developmental biology. His embryological work consisted of experiments in understanding the process of generation, and led him to adopt the model of preformationism called ovism (the idea that the new individual exists within the maternal egg prior to conception). Haller was born in Bern, Switzerland, on 16 October, 1708. His mother was Anna Maria Engel, and his father was Niklaus Emanuel Haller. The Hallers were an old family in Bern, and Haller spent the majority of his life there. During his life, Haller made many important contributions to medicine, botany, anatomy, and physiology. Haller became one of the most outspoken supporters of preformationism, and the long debate between Haller and Caspar Friedrich Wolff, who supported the competing theory of epigenesis in which form emerges gradually, is a hallmark of this time period in developmental biology. Haller also formulated an accurate model of the rate of fetal growth during gestation, demonstrating statistically that development at the beginning is more rapid than growth later on.
