My thesis examines the burden of proof in eminent domain valuation proceedings in the state of Arizona. The thesis begins by going back and looking at the history of eminent domain in the United States. This includes identifying the authorities with the power to condemn land and the examining constitutional amendment requiring the condemnor to pay the fair market value for the land it takes. From there, I look at the process of property value litigation and the potential combination of burden of proof on both the value of the land taken and severance damages. This is followed by an analysis of the current law in Arizona, and a comparison to the laws in the other 49 states to highlight trends throughout the nation. The thesis highlights the counterintuitive nature of the landowner bearing the burden of proving fair market value in Arizona while also pointing out that the majority of other states in the nation have similar laws. This law continues to exist despite a lack of historical precedent or justification, not only in Arizona, but also throughout the country. The thesis references different states' case law throughout and gives opinions of experts in this area of study. The final section examines the practical implications of the law as it exists in Arizona today. The law may continue to exist unopposed despite its counterintuitive nature, because it gives the defendant landowner's counsel the right to speak first and last in a trial and present their evidence first. This has the potential to offer an advantage large enough to justify an unwanted burden.

Community Music Therapy for Cultural Cohesion is the name of the research initiative to create a community music therapy program that addresses community attitudes toward cultural diversity. The program created is titled "Many Peoples, One Voice." Theories and findings in the field of social psychology regarding the formation of intergroup bias and how to prevent it from taking hold inform the goals of the program. Current practices in and theories on community music therapy inform the content, qualities, and perspective of the program. Information from the field of ethnomusicology inform the specific world music traditions incorporated into the program. The culmination of this research and the program it birthed is described in detail to promote a better understanding of the goals, activities, cultural handouts, additional content considerations, and structure of the program as well as the populations it may serve and the adaptions it may include. Finally, the program is related to the current trends in the field of music therapy and its potential to expand into nontraditional need and population areas is considered.

Nations have a vital interest in creating a citizenry with certain attributes and beliefs and, since education contributes to the formation of children's national identity, government authorities can influence educational curricula to construct their ideal citizen. In this thesis, I study the educational systems of Pakistan and Arizona and explore the historical and conceptual origins of these entities' manipulation of curricula to construct a particular kind of citizen. I argue that an examination of the ethnic studies debate in Tucson, Arizona, in conjunction with Pakistan's history education policy, will illustrate that the educational systems in both these sites are developed to advance the interests of governing authorities. Resource material demonstrates that both educational systems endorse specific accounts of history, omitting information, perspectives, and beliefs. Eliminating or reimagining certain narratives of history alienates some students from identifying as citizens of the state, particularly when contributions of their ethnic, cultural, or religious groups are not included in the country's textbooks.

This thesis investigates the environment of support for reclassified English Language Learners (RCELLs) in Arizona schools. Arizona English Language Learner (ELL) policy and pedagogy have been the subjects of research nationwide; many studies demonstrate that ELLs struggle before, during and after participating in Arizona ELL programs (Lillie et al. 2012; Roa 2012; Garcia, Lawton & de Figuieredo 2012; Office of Civil Rights 2012). Despite evidence that the achievement gap between RCELLs and mainstream students is not closing, little information is available about additional language support that RCELLs might receive in mainstream classrooms. This thesis addresses that void of information through: 1) A literature review of the framework of RCELL support, as outlined by the Arizona Department of Education and relevant studies, and 2) a study of teacher and principal opinion about support components for RCELLs and whether such support is adequate. Study findings present that teachers and principals generally believe RCELLs are well-supported, in terms of both the availability and quality of study-defined support components. Yet there is only weak consensus among teachers that support components are adequate. Additionally, teachers' knowledgeability related to important RCELL support components is low, undermining the reliability of teacher responses. The disconnect between participants' optimistic perceptions of support and the external evidence of low RCELL achievement is rationalized by two conjectures. The first is that teachers are not knowledgeable about RCELL support components and cannot accurately gauge the quality of such support. The second is that existing support components are effective at assisting RCELLs with English learning but are not sufficient to close RCELL academic content achievement gaps.

Sports teams are an integral part of a city. They attract revenue to the area around the stadium and they also give a city a sense of pride. The aim of this study was to determine what makes a team successful in the area of attendance using four factors (Bernthal & Graham; Jensen; Kim, Trail & Magnusen; Edensor & Millington; Clowes & Tapp; Greenhalgh & Greenwell; Denaux & Yalcin; Paul & Weinbach & Robbins; Levin & McDonald; Lee & Kang; Drayer; L'Etang; McDonald & Rascher; Armstrong; Ross): the history of the team, the location and population of the city where the team plays, the social media following of the team and the promotional giveaways the team uses to attract fans. Using these four factors, a comparison was made among the Arizona teams and the top performing team in attendance in the respective leagues during the 2013 season. The Arizona Diamondbacks are compared with the Los Angeles Dodgers. The Diamondbacks were not as equipped as the Dodgers in any of the categories. There is a more storied history for the Dodgers, the Dodgers play in Los Angeles - a significantly larger city that Phoenix, where the Arizona Diamondbacks play, they use social media more frequently and more effectively, and they offer more promotional giveaways than the Diamondbacks. The Phoenix Suns are compared to the Chicago Bulls. The Suns history competes with the Bulls, but they lack in the other three categories. The Bulls have a better location in Chicago, their stadium is located in the downtown area; they have a massive social media following and their promotional giveaways are more substantial. The Phoenix Coyotes are compared to the Chicago Blackhawks. The Blackhawks exceeded in all of the categories, while the Coyotes were poor performers in each of the four factors. The Blackhawks have a storied history, they share a stadium with the Bulls, they have a great social media following and they give promotional items away 30 of the 41 home games. The overall recommendations for the teams are to win, in order to help build their locations and make it fun to be near the downtown area, to use social media effectively and engage with their audience, and finally to provide more promotional giveaways to attract people to the games.

This case study analyzes

Each year the United States' interstates and roadways become increasingly congested, with little development of useful mass transit. Elon Musk released a whitepaper titled Hyperloop Alpha in order to generate conversation around a potential "fifth mode of transportation" as an alternative to current high-speed rail technologies. This case study analyzes the implications of implementing the Hyperloop along the 120-mile Phoenix-Tucson route in terms of the State's geographic, economic, political, and environmental advantages for the Hyperloop design. This case study was not meant to investigate the engineering aspects of an untested technology, but rather to generate conversation and elicit enthusiasm in the State of Arizona in order to bring the project in-house. Through comparison of the California context of the Hyperloop and other megaregions this report proposes that given Arizona's solar power production potential, short, flat, undeveloped route, explosive population growth, urban density distribution, recognized need for HSR, and strong research institutions make it the ideal site and premiere candidate for initial Hyperloop testing and construction.

The Science of Water Art project is a collaborative work that brings together professionals, community members, college students and children to think about the role that water plays in each of our lives. Using a sample of 4th grade classrooms in Maricopa County, over 3000 drawings of children's perception of water today and in the future were collected. The 9-11 year olds were asked to draw pictures of 1) how they saw water being used in their neighborhood today (T1), and 2) how they imagined water would be used in their neighborhood 100 years from now (T2). The artwork was collected and coded for nine different themes, including: vegetation, scarcity, pollution, commercial sources of water, existing technology, technology innovation, recreational use, domestic use, and natural sources of water. Statistically significant differences were found between boys and girls for vegetation, technology and domestic use themes. This project allows for a look into how climate change and water insecurity is viewed by younger generations and gives a voice to children so that they may share their outlooks on this vital resource.

Data were collected from 87 participants over a one-month period

The Community Action Research Experiences (CARE) Program collaborated with Maricopa Association of Government to assess the needs of domestic violence victim advocates in Maricopa County to determine how their work could be enhanced through additional advocacy training and support services. Data were collected from 87 participants over a one-month period by distribution of an electronic survey. Sixty participants completed the survey, and 27 partially completed the survey. Only the data received from the 60 participants who completed the survey were used in reporting the results. The results indicated a perceived need for more training for advocates, specifically for advocates during their first year on the job. The results also indicated that while domestic violence victim advocates work in different agencies, they expressed significant interest in working collaboratively with advocates from other fields to increase cooperation and coordination among agencies to ensure that victims receive the best possible services.

The Phoenix-Metro area currently has problems with its transportation systems. Over-crowded and congested freeways have slowed travel times within the area. The Phoenix-Metro area currently has problems with its transportation systems. Over-crowded and congested freeways have slowed travel times within the area. Express bus transportation and the existence of "High Occupancy" lanes have failed to solve the congestion problem. The light rail system is limited to those within a certain distance from the line, and even the light rail is either too slow or too infrequent for a commuter to utilize it effectively. To add to the issue, Phoenix is continuing to expand outward instead of increasing population density within the city, therefore increasing the time it takes to travel to downtown Phoenix, which is the center of economic activity. The people of Phoenix and its surrounding areas are finding that driving themselves to work is just as cost-effective and less time consuming than taking public transportation. Phoenix needs a cost-effective solution to work in co- existence with improvements in local public transportation that will allow citizens to travel to their destination in just as much time, or less time, than travelling by personal vehicle.
