An ethical dilemma is not a matter of “right” versus “wrong,” but rather it is a situation of conflicting values. A common ethical dilemma is that of honesty versus loyalty—is it better to tell the truth, or remain loyal to the company? In the Japanese culture, truth is circumstantial and can vary with different situations. In a way, the Japanese idea of honesty reflects how highly they value loyalty. This overlap of values results in the lack of an ethical dilemma for the Japanese, which creates a new risk for fraud. Without this struggle, a Japanese employee does not have strong justification against committing fraud if it aligns with his values of honesty and loyalty.
This paper looks at the Japanese values relating to honesty and loyalty to show how much these ideas overlap. The lack of a conflict of values creates a risk for fraud, which will be shown through an analysis of the scandals of two Japanese companies, Toshiba and Olympus. These scandals shine light on the complexity of the ethical dilemma for the Japanese employees; since their sense of circumstantial honesty encourages them to lie if it maintains the harmony of the group, there is little stopping them from committing the fraud that their superiors asked them to commit.
In a global economy, understanding the ways that values impact business and decisions is important for both interacting with others and anticipating potential conflicts, including those that may result in or indicate potential red flags for fraud.

Executive compensation is broken into two parts: one fixed and one variable. The fixed component of executive compensation is the annual salary and the variable components are performance-based incentives. Clawback provisions of executive compensation are designed to require executives to return performance-based, variable compensation that was erroneously awarded in the year of a misstatement. This research shows the need for the use of a new clawback provision that combines aspects of the two currently in regulation. In our current federal regulation, there are two clawback provisions in play: Section 304 of Sarbanes-Oxley and section 954 of The Dodd\u2014Frank Wall Street Reform and Consumer Protection Act. This paper argues for the use of an optimal clawback provision that combines aspects of both the current SOX provision and the Dodd-Frank provision, by integrating the principles of loss aversion and narcissism. These two factors are important to consider when designing a clawback provision, as it is generally accepted that average individuals are loss averse and executives are becoming increasingly narcissistic. Therefore, when attempting to mitigate the risk of a leader keeping erroneously awarded executive compensation, the decision making factors of narcissism and loss aversion must be taken into account. Additionally, this paper predicts how compensation structures will shift post-implementation. Through a survey analyzing the level of both loss- aversion and narcissism in respondents, the research question justifies the principle that people are loss averse and that a subset of the population show narcissistic tendencies. Both loss aversion and narcissism drove the results to suggest there are benefits to both clawback provisions and that a new provision that combines elements of both is most beneficial in mitigating the risk of executives receiving erroneously awarded compensation. I concluded the most optimal clawback provision is mandatory for all public companies (Dodd-Frank), targets all executives (Dodd-Frank), and requires the recuperation of the entire bonus, not just that which was in excess of what should have been received (SOX).

This thesis provides an analysis of company culture in well-known and relevant businesses to identify a successful company culture and create an outline for businesses to follow when designing or revamping their culture. This included research and analysis of successful and unsuccessful company cultures and the affect they have on customers, employees and employers. This analysis created measurements to use to identify good company culture and bad company culture. These were identified through evaluations of employee reviews, secondary research and business articles. From there, different parts of company culture were identified as key components to building a strong, prideful and successful company culture and alternatively, what deteriorates a company culture. As a result of this thesis I uncovered measurements to use to identify a good company culture and six critical success factors to outline a successful company culture that can be tailored to any business. The measurements were surrounding retention rates, innovation, company development, employee perks, a fun atmosphere and an overall attention to employee needs. The critical success factors of company culture are to set the mission and vision of the company, define the company's core values, set a budget for company culture expenses, add special perks or actions that make your culture unique, hire and train right from the start and most importantly follow through. These factors create an outline for how to structure a great company culture, but do not set boundaries for any company. The best company culture is authentic to a company's mission, goals, customers and employees.

Entering into my final year of W. P. Carey, I decided I wanted my thesis to combine what I've learned over the course of my undergraduate Marketing degree with my passion for baseball. Furthermore, I wanted my thesis to contain both a research element and creative application. I felt the best way to achieve the integration of these goals was to research and then select an MLB team to relocate to a more attractive American market. After performing research to determine an ideal team and city for relocation, I created a comprehensive marketing strategy to best cater this team for its new market. The first half of my thesis focuses entirely on the research required to select an optimal team and attractive market for relocation. I begin my thesis by performing an external analysis of the current MLB landscape. To elaborate, I gathered W-L records and fan attendance records for all 30 MLB teams between 2000 and 2016. I also collected the most recent team revenues and valuations before putting all of this data in Excel to create visual graphs. Using this data, I determine a list of the top 4 most attractive teams for relocation based on consistently poor performance in the metrics I collected data on. After selecting the Tampa Bay Rays as the ideal team to relocate, I then dive deeper into the organization through an internal analysis. Then, I focus on performing an external analysis of the most attractive markets for relocation before ultimately selecting Charlotte, NC as the best city. My research ends with a comprehensive external analysis of the Charlotte, NC market to help in creating a brand that caters to the makeup and culture of the distinct city. My analysis of Charlotte focuses on the city's demographics, population growth, local economy, political environment and trends that could impact target market segments. After performing extensive research on identifying the best team and city for a relocation, I switch gears to developing a comprehensive marketing strategy to best help the team achieve success in its new market. This begins with creating a unifying segmentation, targeting, and positioning strategy to outline the direction the team will take. These strategies place tremendous emphasis on the need for the Charlotte team to create an "irresistible cultural experience" that expands the traditional MLB mold to attract young Millennial fans to games that normally wouldn't be interested in attending games. Next, I begin by developing key elements of the brand including the team name, logos, uniforms, sponsors, and stadium. With the stadium, I even go as far as determining an ideal location along with unique features, such as lawn seating and even local vendors that have appeared on Food Network to add to the cultural experience of the brand. Then, I focus on a unifying initial marketing campaign through TV/print ads, radio ads, social media, and public relations to help the team seamlessly transition into its new home. My thesis ends with recommendations for future steps to take to ensure the relocated organization achieves lasting success in its new city.

Over the past several decades, analytics have become more and more prevalent in the game of baseball. Statistics are used in nearly every facet of the game. Each team develops its own processes, hoping to gain a competitive advantage over the rest of the league. One area of the game that has struggled to produce definitive analytics is amateur scouting. This project seeks to resolve this problem through the creation of a new statistic, Valued Plate Appearance Index (VPI). The problem is identified through analysis that was performed to determine whether any correlation exists between performances at the country's top amateur baseball league, the Cape Cod League, and performances in Major League Baseball. After several stats were analyzed, almost no correlation was determined between the two. This essentially means that teams have no way to statistically analyze Cape Cod League performance and project future statistics. An inherent contextual error in these amateur statistics prevents them from correlating. The project seeks to close that contextual gap and create concrete, encompassing values to illustrate a player's offensive performance in the Cape League. To solve for this problem, data was collected from the 2017 CCBL season. In addition to VPI, Valued Plate Appearance Approach (VPA) and Valued Plate Appearance Result (VPR) were created to better depict a player's all-around performance in each plate appearance. VPA values the quality of a player's approach in each plate appearance. VPR values the quality of the contact result, excluding factors out of the hitter's control. This statistic isolates player performance as well as eliminates luck that cannot normally be taken into account. This paper results in the segmentation of players from the 2017 CCBL into four different groups, which project how they will perform as they transition into professional baseball. These groups and the creation of these statistics could be essential tools in the evaluation and projection of amateur players by Major League clubs for years to come.

Given its impact on the accounting profession and public corporations, Sarbanes-Oxley Act of 2002(SOX) is a widely researched regulation among accounting scholars. Research typically focuses on the impact it has had on corporations, executives and auditors, however, there is limited research that illustrates the impact SOX may have on average Americans. There were several US criminal code sections that resulted from the passing of SOX. Statute 1519, which is often referred to as the "anti-shredding provision", penalizes anyone who "knowingly alters, destroys, mutilates, conceals, covers up, falsifies, or makes a false entry in any record, document, or tangible object with the intent to" obstruct a current or foreseeable federal investigation. This statute, although intended to punish behavior similar to that which occurred in the early 2000s by corporations and auditors, has been used to charge people beyond its original intent. Several issues with the crafting of the statute cause its broad application and some litigation even reached the Supreme Court due to its vague wording. Not only is the statute being applied beyond the intent, there are other issues that legal scholars have critiqued it for. This statute is far from being the only law facing these issues as the same issues and critiques are found in the 14th amendment. Rewriting the statute seems to be the most effective way to address the concerns of judges, lawyers and defendants regarding the statute. In addition, Congress could have passed this statute outside of SOX to avoid being seen as overreaching if obstruction of justice related to documents was actually an issue outside of corporate fraud.

This study examined if Hofstede's cultural dimensions are able to predict the scheme used to commit fraud and the frequency of the scheme. All six of Hofstede's cultural dimensions were applied to 9 different countries across the world. These countries were selected based on the number of fraud cases that were reported in the 2016 Report to the Nations published by the Association for Certified Fraud Examiners. The theory was that Hofstede's Cultural dimensions would be able to predict the scheme that would be used to commit fraud. The results however do not support this hypothesis. There were some significant relationships between some of the schemes and Hofstede's cultural dimensions. However there were some of the schemes that had no significant relationships which could be due to the limitations of this study.

From exploring coffee plantations with an old Irishman in the mountains of Colombia to watching the sun set over the Strait of Gibraltar from the terrace of an ancient Moroccan cafe, this thesis sent Charles and Zane on an elaborate cafe-crawl across ten countries, with stops at a few of the world’s most interesting coffee houses. Some of these cafes, such as the world-renowned Caffé Florian (opened in 1720) and Caffé Greco (1760), are built on long-standing traditions. Others are led by innovators championing high-quality boutique shops, challenging mass production chains such as Starbucks and Tim Hortons. These newer cafes fuel a movement classified as the “Third Wave”. With a foundation gained from specialized courses with Patrick O’Malley, North America’s leading voice in coffee, Zane and Charles conducted first-hand research into the unique coffee preferences of multiple cultures, the emergence and impact of the Third Wave in these countries, and what the future may hold for coffee lovers.

In 2021-2022, MLB underwent a labor stoppage due to a failure between the league and union to sign a new collective bargaining agreement (CBA) for the 2022 season until mid-March of 2022. This failure led to a contentious debate between owners and players over economic, competitive balance, and gameplay issues.

In 2021-2022, MLB underwent a labor stoppage due to a failure between the league and union to sign a new collective bargaining agreement (CBA) for the 2022 season until mid-March of 2022. This failure led to a contentious debate between owners and players over economic, competitive balance, and gameplay issues. To evaluate how MLB has reached this point in labor relations and make predictions for the future, it is first important to look at the history of sports and collective bargaining and, more specifically, this history in baseball. Next, one should evaluate the history of the antitrust exemption and its impact on labor relations in MLB. It is then important to analyze the main tenets of the 2022 CBA and their implications. Following this historical and current analysis, one can make hypotheses about where baseball labor relations and antitrust laws are heading and what will be key issues to look toward in the future.
