We integrate multiple domains of psychological science to identify, better understand, and manage the effects of subtle but powerful biases in forensic mental health assessment. This topic is ripe for discussion, as research evidence that challenges our objectivity and credibility garners increased attention both within and outside of psychology. We begin by defining bias and provide rich examples from the judgment and decision making literature as they might apply to forensic assessment tasks. The cognitive biases we review can help us explain common problems in interpretation and judgment that confront forensic examiners. This leads us to ask (and attempt to answer) how we might use what we know about bias in forensic clinicians’ judgment to reduce its negative effects.

We conducted an international survey in which forensic examiners who were members of professional associations described their two most recent forensic evaluations (N=434 experts, 868 cases), focusing on the use of structured assessment tools to aid expert judgment. This study describes:

1. The relative frequency of various forensic referrals.
2. What tools are used globally.
3. Frequency and type of structured tools used.
4. Practitioners’ rationales for using/not using tools.

We provide general descriptive information for various referrals. We found most evaluations used tools (74.2%) and used several (on average 4). We noted the extreme variety in tools used (286 different tools). We discuss the implications of these findings and provide suggestions for improving the reliability and validity of forensic expert judgment methods. We conclude with a call for an assessment approach that seeks structured decision methods to advance greater efficiency in the use and integration of case-relevant information.

This survey of 206 forensic psychologists tested the “filtering” effects of preexisting expert attitudes in adversarial proceedings. Results confirmed the hypothesis that evaluator attitudes toward capital punishment influence willingness to accept capital case referrals from particular adversarial parties. Stronger death penalty opposition was associated with higher willingness to conduct evaluations for the defense and higher likelihood of rejecting referrals from all sources Conversely, stronger support was associated with higher willingness to be involved in capital cases generally, regardless of referral source. The findings raise the specter of skewed evaluator involvement in capital evaluations, where evaluators willing to do capital casework may have stronger capital punishment support than evaluators who opt out, and evaluators with strong opposition may work selectively for the defense. The results may provide a partial explanation for the “allegiance effect” in adversarial legal settings such that preexisting attitudes may contribute to partisan participation through a self-selection process.

Using confirmatory factor analyses and multiple indicators per construct, we examined a number of theoretically derived factor structures pertaining to numerous trust-relevant constructs (from 9 to12) across four institutional contexts (police, local governance, natural resources, state governance) and multiple participant-types (college students via an online survey, community residents as part of a city’s budget engagement activity, a random sample of rural landowners, and a national sample of adult Americans via an Amazon Mechanical Turk study). Across studies, a number of common findings emerged. First, the best fitting models in each study maintained separate factors for each trust-relevant construct. Furthermore, post hoc analyses involving addition of higher-order factors tended to fit better than collapsing of factors. Second, dispositional trust was easily distinguishable from the other trust-related constructs, and positive and negative constructs were often distinguishable. However, the items reflecting positive trust attitude constructs or positive trustworthiness perceptions showed low discriminant validity. Differences in findings between studies raise questions warranting further investigation in future research, including differences in correlations among latent constructs varying from very high (e.g., 12 inter-factor correlations above .9 in Study 2) to more moderate (e.g., only 3 correlations above .8 in Study 4). Further, the results from one study (Study 4) suggested that legitimacy, fairness, and voice were especially highly correlated and may form a single higher-order factor, but the other studies did not. Future research is needed to determine when and why different higher-order factor structures may emerge in different institutional contexts or with different samples.

This chapter integrates from cognitive neuroscience, cognitive psychology, and social psychology the basic science of bias in human judgment as relevant to judgments and decisions by forensic mental health professionals. Forensic mental health professionals help courts make decisions in cases when some question of psychology pertains to the legal issue, such as in insanity cases, child custody hearings, and psychological injuries in civil suits. The legal system itself and many people involved, such as jurors, assume mental health experts are “objective” and untainted by bias. However, basic psychological science from several branches of the discipline suggest the law’s assumption about experts’ protection from bias is wrong. Indeed, several empirical studies now show clear evidence of (unintentional) bias in forensic mental health experts’ judgments and decisions. In this chapter, we explain the science of how and why human judgments are susceptible to various kinds of bias. We describe dual-process theories from cognitive neuroscience, cognitive psychology, and social psychology that can help explain these biases. We review the empirical evidence to date specifically about cognitive and social psychological biases in forensic mental health judgments, weaving in related literature about biases in other types of expert judgment, with hypotheses about how forensic experts are likely affected by these biases. We close with a discussion of directions for future research and practice.

The present paper juxtaposes self-efficacy with self-confidence in terms of theoretical foundations and practical implications, with attention to the area of witness testimony.

Self-Efficacy Theory (SET; Bandura, 1986, 2000) has generated research and practice ramifications across areas of psychology. However, self-efficacy has yet to be assessed in a legal context. The present paper juxtaposes self-efficacy with self-confidence in terms of theoretical foundations and practical implications, with attention to the area of witness testimony. It is concluded that the concept of witness self-efficacy possesses thorough theoretical grounding as a potential target for witness preparation. As such, we put forth an integrated model of witness preparation featuring self-efficacy bolstering techniques within an established witness training framework.

Cities with a car-oriented mobility system are significant consumers of energy and require drastic transformations in their structure and function to minimize their harmful impacts on environment and people and to achieve sustainability goals. To promote such sustainable transformations, municipal administrators need to act as change-agents. Because municipal governments are often not agile organizations, they tend toward incrementalism even in the pursuit of transformational goals. Therefore, there is a need in municipal governments to build individual transformative capacity so that municipal administrators can design, test, and implement plans, projects, and policies that are capable of transforming cities toward sustainability. This research presents a game-based workshop, “Stadt-liche Ziele” (AudaCity), that uses a backcasting approach to make municipal administrators build a sustainability strategy. I conducted a pilot study to test the effects of the game on municipal administrators’ confidence in their own ability and power to implement sustainability actions, a key determinant of transformative capacity. Five municipal administrators from Lüneburg, Germany, working on mobility issues, participated in a three-hour-workshop playing the game. Interviews and questionnaires were used before and after the workshop and participants’ contributions during the event were recorded to explore collective changes in confidence. Results indicate that the game increased participant confidence by rewarding collective success, breaking down an ambitious goal into achievable tasks, and acknowledging how administrators’ current actions already contribute to the goal.

COVID-19 brought so much uncertainty into the world and has molded this project into what it is today. The first project journey that was chosen was meant to show the impact of how much plastic waste was being produced at Starbucks. Then due to COVID-19 yet again, it changed into how much paper waste there was within the State of Washington Department of Licensing (DOL) Business and Professions Division (BPD). DOL BPD is a state agency division that licenses over forty plus professional and business licenses to the residents of Washington state. Due to the pandemic, the project transformed into how the three pillars of sustainability impacts remote work within BPD. BPD is in this new and unique paradigm where the deliverable that was brought forth as this project completed are, “The 9 Benefits of Sustainability through Remote Work” (Appendix D) where this specifically showed DOL why remote work is sustainable and how it should be implemented even further throughout the agency. This list was put together with the benefits that best fit DOL BPD.
