The role of the American police is to work for and with the communities they serve. The relationship between police and community, however, has not always been a positive one. In recent decades, police organizations throughout the United States have attempted various approaches to addressing the problem. Most recently, they have been focused on improving that relationship by enhancing their legitimacy. This practice is commonly known as the process-based model of policing: theoretically, a procedurally just interaction will enhance legitimacy, which in turn will enhance willingness to cooperate with the police. The benefit for police agencies in enhancing legitimacy lies in the idea that when the police are perceived as a legitimate entity, the public will be more likely to cooperate with them. Enhancing police legitimacy also offers benefits for the public, as this is preceded by a procedurally just interaction.

The goal of this dissertation is to assess the applicability of the process-based model of policing to an under-studied population: Hispanics and undocumented immigrants residing within Maricopa County, Arizona. The analysis for this dissertation uses data from two different sources: a sample of Maricopa County residents (n=854) and a sample of Maricopa County arrestees (n=2268). These data are used to assess three research questions. The first research question focuses on assessing the applicability of the process-based model of regulation as a theoretical framework to study this population. The second research question compares Hispanic and White respondents’ views of procedural justice, police legitimacy, and how these perceptions relate to their willingness to cooperate with the police. The last research question examines the differences between undocumented immigrants’ and U.S. citizens’ perceptions of procedural justice, police legitimacy, and how these perceptions relate to their willingness to cooperate with the police. In doing so, this study examined the convergent and discriminant validity of key theoretical constructs. Among several notable findings, the results show that the process-based model of regulation is a promising framework within which to assess perceptions of the police. However, the framework was only supported by the sample of arrestees. Implications for theory, practice, and suggestions for future research are discussed.

Legal socialization examines how people acquire their views about the law. A key tenet within this field is that fair interactions with nonlegal authorities, such as teachers, influence people’s legal values (i.e., the ubiquity hypothesis) which subsequently influences how people judge legal authority later in life. This study uses data from the New Hampshire Youth Survey to test the ubiquity hypothesis. Participants completed measures of how procedurally just their teachers were in general, as well as the procedural justice of their least and favorite teachers. Approximately 45 days later, they participated in an experiment where they read a vignette describing an interaction between a police officer and a young adult. Participants read vignettes where the officer either did or did not give a voice to the young adult and did or did not behave in a neutral manner. After reading the vignette, participants were asked to judge the procedural justice and legitimacy of the officer. The results indicated students’ judgments of the officer’s procedural justice were not influenced by prior experiences with teacher procedural justice. Judgments of officer legitimacy, on the other hand, were associated with teacher procedural justice, specifically participant’s least favorite teacher. These results indicate a more nuanced view of the ubiquity hypothesis than has been portrayed by legal socialization scholars whereby prior experiences with nonlegal authority affect some legal judgments but not others.

This thesis addresses two research questions: how are police officer activities in high crime areas influenced by training on procedural justice?, and how do differences in the activities among trained and untrained officers help explain changes in the perceptions of residents about police procedural justice and police legitimacy? Written activity logs used by police officers during a hot spots policing project in Tucson, AZ were transferred to a database and coded for the types of activities officers were taking part in. Surveys administered to residents before and after the project were used to create scales for procedural justice and police legitimacy. These data revealed that police officers trained in procedural justice emphasize different principles in their activities than untrained officers. Procedural justice trained officers did not speak to as many citizens as officers who did not receive additional training, nor did they engage with the community as much, but they did perform more foot and high-visibility patrols. The findings also reveal that resident perceptions are minimally affected by such training and their perceptions of procedural justice and police legitimacy are not significantly hurt. Based off these findings, recommendations for moving forward with procedural justice training include emphasizing how the department would like to see their officers behave and making clearer objectives part of the training. Future research should focus more on better understanding how resident perceptions can be influenced by officer activities.

This thesis expands on Procedural Justice Theory (PJT), which argues that all else equal, judgments of fairness are most strongly motivated by process and relational factors of an interaction. This includes neutral, consistent, and transparent decision-making as well as respectful and dignified interpersonal treatment. The bounded authority perspective argues that judgments of fairness are also influenced by evaluations of police respecting the boundaries of their authority and not overstepping into domains under personal jurisdiction. This study tests this argument using an online convenience sample (n =1048) recruited from Prolific Academic. Respondents completed surveys at three time points between April and June of 2020 that included measures of procedural justice, distributive justice, bounded authority, and overall fairness judgments of the police. Across all three waves, results showed that procedural justice, distributive justice, and bounded authority had strong positive associations with police fairness. Procedural justice had a significantly stronger association than either distributive justice or bounded authority, while the latter factors were not significantly different. I discuss the implications for our criminal justice and directions for future research as well the need for a representative sample and use of experimental design to clarify the impact of bounded authority concerns.

Research on Tyler’s process-based model has found strong empirical support. The premise of this model is that legitimacy and legal cynicism mediate the relationship between procedural justice and compliance behaviors. Procedural justice and legitimacy in particular have been linked to compliance and cooperation and a small, but growing body of literature has examined how these factors relate to criminal offending. There remains a number of unanswered questions surrounding the developmental processes and underlying mechanisms of procedural justice and legal socialization. The purpose of this study is twofold. First, this study will build upon recent trends in the literature to examine what factors influence changes in perceptions of procedural justice and legal socialization attitudes over time. In order to do so, the effects of a number of time-stable and time-varying covariates will be assessed. Second, this study will evaluate the effects of four possible mediating measures—legitimacy, legal cynicism, anger, and prosocial motivation—underlying the relationship between procedural justice and criminal offending. This section of the study will use a multilevel mediation method to assess whether mediation occurs between or within the individual.

Data from the Pathways to Desistance Study—a longitudinal study of 1,354 adolescents adjudicated of a serious offense followed-up for seven years—are used to address this research agenda. Results from this study offer three general conclusions. First, results show that perceptions of procedural justice are malleable, that is, they can change over time and are influenced by a number of factors. Legal socialization beliefs, however, demonstrate only marginal change over time, suggesting these beliefs to be more stable. Second, analyses indicate differing pathways and effects for direct and vicarious experiences of procedural justice. Finally, the multilevel mediation analyses reveal that within-individual changes in direct experiences of procedural justice remains a robust predictor of offending, regardless of the presence of mediating variables. Legitimacy was found to have the strongest mediation effect on between-individual differences in direct procedural justice, whereas anger partially mediated the effects of between-individual differences in vicarious procedural justice. This study concludes with a discussion of policy implications and avenues for future research.

The data revealed that police officers trained in legitimacy and procedural justice emphasize different principles in their activities from untrained officers, and even within the trained group there were differences observed. Based off these findings, recommendations for moving forward with this training include emphasizing the principles the department would like to see them enforce and making clearer objectives part of the training.

Due to numerous instances of police brutality in the U.S., researchers and policymakers have urged police to shift their job orientation to become more guardian-oriented (i.e., prioritizing community safety and building relationships) and less warrior-oriented (i.e., prioritizing physical control and fighting crime). Using the group engagement model and the expectancy disconfirmation hypothesis, this study examined: (1) young adults’ desire for police to be warrior- or guardian-oriented, (2) their perceptions of the extent to which police in their community are warrior- or guardian-oriented, and (3) the association between participants’ perceptions of the discrepancy between what police in their community should be versus are perceived to actually be and police legitimacy. In this study, a racially and ethnically diverse sample of young adults aged 18-25 in the United States (N = 436) responded to a self-report survey. Participants preferred police to have more of a guardian than warrior orientation and reported that police are not as guardian oriented as they wanted them to be. Further, if police did not meet their guardian expectations, young adults had more negative perceptions of police legitimacy. Expectations for police behavior may influence police legitimation and, within the context of police reform, young adults support the call for police to be more guardian-oriented by prioritizing community safety and building relationships. Fostering a guardian orientation in police is particularly important for police departments that are interested in promoting perceptions of legitimacy among the communities they serve.
