Since 9/11 a wide range of violent practices including indefinite detention, torture, and targeted killing have been employed by the United States and the "international community" against "international terrorism." Modern laws of war are portrayed as the bright line that distinguishes the "international community" from "unlawful combatants." The threat posed by unlawful combatants has been portrayed as so exceptionally grave that the international community is justified in the transgression of those very laws of war that constitute the distinction between "us" and "them." In consequence the efficacy of modern laws of war to provide humanitarian protections has been cast into doubt and many characterize humanitarian laws of war as obsolete. Existing work on the politics of exception and the exclusion of Guantánamo Bay detainees from US federal law does not frame the problem of the exception in terms of international law. Though many consider the prerequisites for politics of exception absent in the international system, I argue that a dispersed notion of sovereignty and constructivist approaches to law resolve obstacles to considering the exception at the level of the state system. I explore system level exceptional politics through a critical reading of modern laws of war. Rejecting essentialist historical narratives, I first conduct a genealogical study of laws of war from ancient Greece through the Middle Ages. I then conduct a critical reading of three texts from the War on Terrorism; Barack Obama's 2009 Nobel Peace Prize acceptance speech, John Brennan's "The Ethics and Efficacy of the President's Counterterrorism Strategy," and Medea Benjamin's interruption of John Brennan. I argue that modern narratives of war law venerate codification and textually privilege a "mystical" figure of modern law. This figure empowers a universalized "international community" as law's privileged agent. Violence employed by this archetypal community, even when outside the law, is rendered ethically pure and historically necessary. In consequence modern humanitarian law as a bright line always permits excluded archetypal identities and vast powers of violence are mobilized by the "international community" against discrete individual human bodies who are identified with this excluded archetype, or who simply find themselves in the way.

This dissertation critically examines whether and how the practices involved in the crafting of the European Union may be said to go beyond modern statecraft. European integration should in part be seen as an attempt to transcend the modern state. Among many of the early proponents of European integration, the nation state had become associated with militarism, jingoism and ultimately, at least partly, to the blamed for the many devastating wars on the European continent, and even a normative order that made the Holocaust possible. Most other studies that have dealt with the EU's alleged difference from the modern state have employed an understanding of the state which confers a certain ontological standing and status onto its purported object of study. This dissertation argues that a critical approach to European integration needs to go beyond such a representationalist, ontologizing understanding of a political entity. Instead, in order to start addressing the question of state violence that European integration emerged as a response to, the crafting of the Europe Union needs to be problematized in relation to practices of statecraft. The dissertation also contends that previous engagements of European integration in relation to the modern state have neglected engaging the broader normative horizon in which the modern Westphalian state is inscribed. The first chapter puts forward a way of understanding modern statecraft. The subsequent chapters examine four different legitimation discourses of European integration against such an understanding: EU's failed Constitutional Treaty, EU's foreign policy discourse, European integration theory, and an instance of European migration policy. The dissertation concludes that the crafting of Europe in many ways resembles the crafting of the modern state. In fact, the crafting of the European Union is plagued by similar ethical dilemmas as the modern state, and ultimately animated by a similar desire to either expel or interiorize difference.

War exacts a great social cost, not only upon its direct participants, but also upon the lives of the friends, family, and community of those who experience it. This cost is particularly evident in the increased frequencies of aggressive behaviors, including homicide, assault, and domestic violence, enacted by Western

War exacts a great social cost, not only upon its direct participants, but also upon the lives of the friends, family, and community of those who experience it. This cost is particularly evident in the increased frequencies of aggressive behaviors, including homicide, assault, and domestic violence, enacted by Western military veterans with posttraumatic stress disorder (PTSD). Similarly, among contemporary non-Westernized peoples, a cross-cultural conducted by Ember and Ember (1994) found a relationship between war and various forms of intragroup violence, including domestic violence, assaults, homicides, and violent sports. It is unknown, however, if this positive association between warfare and intragroup violence extends longitudinally for prehistoric populations uninfluenced by modern states.

To test Ember and Ember’s (1994) results in an archaeological culture, this study examines whether or not an association between war and intragroup violence was present during the Mississippian Period (ca. AD 1000-1450) of the Central Illinois Valley (CIV). The Mississippian Period of the CIV represents an ideal context for examining war and violence questions, as considerable evidence of war and violence has been amassed from archaeological and bioarchaeological analyses. High rates of skeletal trauma, fortification construction, and the placement of habitations sites in defendable areas indicate war was of particular concern during this period. Yet, little is known regarding the diachronic and synchronic variation in violence in this region.

In this research, skeletal remains representing 776 individuals from five CIV sites (Dickson Mounds, Larson, Berry, Crable, and Emmons) were analyzed for violence-related skeletal trauma, biodistance, and mortuary data. From the aggregation of these data, two models of intergroup violence and two models of intragroup violence were explored. The intergroup models examined were: 1) warfare victims from the local community and 2) warfare captives. The intragroup models assessed include: 1) domestic violence and 2) male-male fights. Results support the hypothesis that as intergroup violence increased during the Mississippian Period in the CIV, intragroup violence increased concomitantly. While warfare and intragroup violence occurred in low frequencies early in the Mississippian Period, after AD 1200, both intragroup and intergroup violence were likely endemic.

Across the globe, schools are seen as an essential context for building socio-emotional capacities in adolescents, particularly for marginalized youth, who have been systematically and historically excluded from accessing opportunities and resources typically available to members of different social groups (Gil-Kashiwabara, Hogansen, Geenen, Powers, & Powers, 2007). However, despite this ideal, education has not yet reached its potential in promoting equal outcomes for all children andadolescents (American Psychological Association Presidential Task Force on Educational Disparities, 2012; Burkham & Lee, 2002; Gurria, 2016; Hampden-Thompson & Johnston, 2006). There exists a need to identify school practices that may enhance socio- emotional development and have implications for reducing disparities in academic achievement, educational attainment, and other indicators of well-being.

The aim of this dissertation, therefore, is to explore school and classroom practices that may be particularly effective in supporting the socio-emotional development of marginalized adolescents. I focus on two distinct populations: youth affected by violence in Colombia, and students of color within the United States. In Study 1, I explore whether three aspects of school climate – safety, connectedness, and services – buffer the negative implications of violence exposure for adolescent development in a Colombian sample. In Study 2, I determine how culturally responsive teaching practices in schools with high concentrations of students of color in the United States can be integrated into our current conceptualization of what constitutes high quality teaching, by examining profiles of teaching practices and associations between these profiles and teacher and classroom characteristics and student behaviors.

The use of restrictive housing in prisons is at the forefront of national discussions on crime and punishment. Civil and human rights activists have argued that its use should be limited due to harmful effects on the physical and psychological health of inmates as well as its limited ability to reduce subsequent offending. Stacked against this is the need for correctional administrators to respond to institutional violence in a manner that ideally curtails future violence while doing no further harm to the well-being of those housed in these environments. The current project explores the effectiveness of a Restrictive Status Housing Program (RSHP) designed for inmates who commit violent assaults within the Arizona Department of Corrections. The program, as designed, moves beyond exclusively punitive approaches to segregation by encouraging behavior modification that is influenced by cognitive behavioral training. This study advances the literature and informs correctional policy by: 1) examining the effects of program participation on future behavioral outcomes, and 2) exploring mechanisms through which the program works (or does not work) by interviewing former RSHP participants and staff. The current research uses a mixed-method research design and was carried out in two phases. For Phase 1, quantitative data on behavioral outcomes of program participants (N = 240), as well as a carefully constructed comparison group (N = 1,687), will be collected and analyzed using official records over a one-year follow-up. Phase 2 will examine qualitative data derived from semi-structured interviews with former RSHP participants (n = 25) and correctional staff who oversee the day-to-day management of the program (n = 10). Results from the current study suggest that placement in the RSHP has null, and at times, an adverse effect on subsequent levels of institutional misconduct. Policy implications and recommendations based on these findings are discussed.

A large body of research links victimization to various harms. Yet it remains unclear how the effects of victimization vary over the life course, or why some victims are more likely to experience negative outcomes than others. Accordingly, this study seeks to advance the literature and inform victim service interventions by examining the effects of violent victimization and social ties on multiple behavioral, psychological, and health-related outcomes across three distinct stages of the life course: adolescence, early adulthood, and adulthood. Specifically, I ask two primary questions: 1) are the consequences of victimization age-graded? And 2) are the effects of social ties in mitigating the consequences of victimization age-graded?

Existing data from Waves I (1994-1995), III (2001-2002), and IV (2008-2009) of the National Longitudinal Study of Adolescent Health (Add Health) are used. The Add Health is a nationally-representative sample of over 20,000 American adolescents enrolled in middle and high school during the 1994-1995 school year. On average, respondents are 15 years of age at Wave I (11-18 years), 22 years of age at Wave III (ranging from 18 to 26 years), and 29 years of age at Wave IV (ranging from 24 to 32 years). Multivariate regression models (e.g., ordinary least-squares, logistic, and negative binomial models) are used to assess the effects of violent victimization on the various behavioral, social, psychological, and health-related outcomes at each wave of data. Two-stage sample selection models are estimated to examine whether social ties explain variation in these outcomes among a subsample of victims at each stage of the life course.

The results indicate that the negative consequences of victimization vary considerably across different stages of the life course, and that the spectrum of negative outcomes linked to victimization narrows into adulthood. The effects of social ties appear to be age-graded as well, where ties are more protective for victims of violence in adolescence and adulthood than they are in early adulthood. These patterns of findings are discussed in light of their implications for continued theoretical development, future empirical research, and the creation of public policy concerning victimization.

The nature of the link between a literary text and its film adaptation has been a point of contention within academic thought since the inception of cinema due to the fact that film adaptation forms part of film history since the early 20th century. For most of the past century, the main concern of critics has been the level of fidelity that adaptations exhibit in terms of their relationship with the text, which was viewed as "the original" that directors needed to use as a model. In the last 25 years, however, the discourse of fidelity has been challenged by a number of intellectuals as a result of poststructuralist thought, which rejects the notion of an "original" text and proclaims the existence of infinite meanings within each text that are constructed by the reader, not the writer. The present investigation will take into account this type of epistemology as its starting point in order to review and defy a number of theoretical approximations from the last several decades that deal with the relationship between literature and cinema towards its main goal of overcoming the limitations of fidelity discourse. This will be carried out through an in-depth analysis of Latin American texts that have been adapted to film. Thematically both the literary texts and the films contain elements that portray the reality of marginalized groups that build their existence in opposition to the model of patriarchal heteronormativity. In current epistemological thought such a modus vivendi falls within the realm of queer theory. Another common thread that unites all the cultural productions is the presence of violence that showcases the high level of intolerance towards any subject who somehow seems to be different, hence threatening the dominant configuration of patriarchy. Furthermore, the different texts and films expose a general fragmentation within Latin American society, a result of the constant struggles among its diverse social groups, between the ones who occupy the position of socioeconomic power and those who are left outside of it; such a fragmentation also stems from the multiple clashes that occur within the marginalized groups themselves.

This dissertation seeks to understand two universal experiences that have pervaded human society since man first climbed out of the trees: violence and trauma. Using theories gleaned from the Holocaust and other twentieth century atrocities, this work explores narratives of violent action and traumatic reaction as they occurred among peoples of the nineteenth-century American Southwest. By examining the stories of individuals and groups of Apaches, Ethnic Mexicans, Euro-Americans, and other diverse peoples within the lens of trauma studies, a new narrative emerges within US-Mexico borderlands history. This narrative reveals inter-generational legacies of violence among cultural groups that have lived through trauma and caused trauma within others. For both victims and perpetrators alike, trauma and violence can transform into tools of cultural construction and adaptation.

Part I of this work establishes the concept of ethnotrauma-- a layered experience of collective trauma among minority populations under racial persecution. By following stories of Mescalero, Chiricahua, and Warm Springs Apaches in the nineteenth-century Southwest, this dissertation reveals how Apaches grappled with ethnotrauma through generations during times of war, imprisonment, and exile. These narratives also reveal how Apaches overcame these legacies of pain through communal solidarity and cultural continuity. Part II explores the concept of perpetrator trauma. By following stories of Mexican norteños, Mexican-Americans on the US-Mexico border, and American settlers, the impact of trauma on violators also comes to light. The concept perpetrator trauma in this context denotes the long-term cultural impacts of committing violence among perpetrating communities. For perpetrating groups, violence became a method of affirming and, in some cases, reconstructing group identity through opposition to other groups. Finally, at the heart of this work stands two critical symbols-- Geronimo, victim and villain, and the land itself, hostile and healing-- that reveal how cycles of violence entangled ethnotrauma and perpetrator trauma within individuals struggling to survive and thrive in a savage land.

James Baldwin (1924-1987) was one of the most well-known African American fiction and nonfiction writers of the twentieth century. Throughout his life and career, he earned a worldwide reputation as a respected novelist, memoirist, and essayist who contributed to a wide array of artistic movements and intellectual discourses. Many scholars

James Baldwin (1924-1987) was one of the most well-known African American fiction and nonfiction writers of the twentieth century. Throughout his life and career, he earned a worldwide reputation as a respected novelist, memoirist, and essayist who contributed to a wide array of artistic movements and intellectual discourses. Many scholars have noted the particular African American religious and cultural influences upon Baldwin’s work. More recently, scholars have additionally noted the importance of Baldwin’s globally-engaged thought and internationalist life. Throughout all of his work, Baldwin wrote extensively on the subject of religion. This dissertation posits the topics of religion, violence, and marginalization as integral to his nonfiction writings and speeches, particularly after 1967. As such, it argues that Baldwin in his early career established four distinct discourses on morality, evil, scapegoatism, and purity that he came to connect in his later writings on the intersection of religion, violence, and marginalization. Within these writings, Baldwin also displayed a rigorous engagement with multicultural and multireligious artistic and literary canons, along with the evolving academic study of religion. Therefore, not only should the intersection of religion, violence, and marginalization be a central consideration for Baldwin scholarship, but scholars of religion and violence in particular would benefit from engaging Baldwin’s addressment of this intersection.

This thesis compares and contrasts attitudes on the issue of gun control between the general population and a student sample in the United States today. Through a comparative survey analysis design, this study aims to better understand attitudes towards gun control in the United States. Due to the fact that students may believe they are at a higher risk of gun violence, and because of their increased participation in gun control activism, this thesis hypothesizes that students will be more likely to favor restrictions on gun regulation. Although both samples share similar attitudes, these results show that students held much more passionate, negative, and dissatisfied attitudes and opinions on the current gun climate in the United States, relative to the general public. However, students are less in favor than the sample of the general public in supporting gun-safety policies when in the context of school-settings.
