This thesis examines the Mexican federal judiciary and the problem of corruption in this institution, particularly related to cases of drug trafficking. Given the clandestine nature of corruption and the complexities of this investigation, ethnographic methods were used to collect data. I conducted fieldwork as a "returning member" to the site under study, based on my former experience and interaction with the federal judicial system. I interviewed 45 individuals who work in the federal courts in six different Mexican cities. I also studied case files associated with an important criminal trial of suspected narco-traffickers known in Mexico as "El Michoacanazo." My study reveals the complicated nature of judicial corruption and how it can occur under certain circumstances. I conclude that the Mexican federal judiciary has become a more professional, efficient, and trustworthy institution over the past fifteen years, though institutionalized practices such as nepotism, cronyism, personal abuse of power, and gender inequalities still exist, tending to thwart the full professionalization of these courts and facilitating instances of misconduct and corruption. Although structural factors prevent full professionalization and corruption does occur in these courts, the system works better than it ever has before.

In the past century, a number of technological projects have been undertaken as grand solutions to social problems. In the so called century of biology, this technological world view focuses on biomedical advances. The President of the United States, who once called for nuclear weapons and space exploration, now calls for new biotechnologies, such as genomics, individualized medicine, and nanotechnology, which will improve the world by improving our biological lives. Portrayed as the Manhattan Project of the late 20th Century, the Human Genome Project (HGP) not only undertook the science of sequencing the human genome but also the ethics of it. For this thesis I ask how the HGP did this; what was the range of possibilities of goods and evils imagined by the HGP; and what, if anything, was left out. I show that the Ethical, Legal, and Social Implications (ELSI) research program of the HGP was inscribed with the competencies of the professional field of bioethics, which had lent itself useful for governing biomedical science and technology earlier in the 20th century. Drawing on a sociological framework for understanding the development of professional bioethics, I describe the development of ELSI, and I note how the given-in-advance boundaries between authorized/unauthorized questions shaped its formation and biased technologically based conceptualizations of social problems and potential solutions. In this sense, the HGP and ELSI served both as the ends of policy and as instruments of self-legitimation, thus re-inscribing and enacting the structures for these powerful sociotechnical imaginaries. I engage the HGP and ELSI through historical, sociological, and political philosophical analysis, by examining their immediate context of the NIH, the meso level of professional/disciplinary bioethics, and the larger context of American democracy and modernity. My argument is simultaneously a claim about how questions are asked and how knowledge and expertise are made, exposing the relationship between the HGP and ELSI as a mutually constitutive and reciprocally related form of coproduction of knowledge and social structures. I finish by arguing that ELSI is in a better position than bioethics to carry out the original project of that field, i.e., to provide a space to elucidate certain institutionally authorized questions about science and technology. Finally, I venture into making a prophecy about the future of ELSI and bioethics: that the former will replace the latter as a locus for only formally rational and thin ethical debates.

Indian water rights and Indian water settlements have emerged as a means for resolving long-standing despites and water rights claims. Working with and understanding water rights demands a genuine knowledge of water issues that are specific to each indigenous community as there are cultural aspects and perspectives towards water that are involved. The Gila River Indian Community is an indigenous community in south central Arizona, whose cultural and historic origins span over two millennia. Their foundation as a people was tied to the presence of the Gila and Salt Rivers, from which they freely diverted its waters through hundreds of miles of hand-dug canals, to transform the Sonoran desert into a desert oasis. There is a historical progression of this Community's water rights from when water was abundant to the time it was scarce, leading to an outright denial of a livelihood where water and farming was central to their way of life. A water rights settlement was an option that was pursued because it offered a chance for the Community to see the return of their water. The 2004 Gila River Indian Community Water Rights Settlement has been recognized as the largest Indian water rights settlement in United States history and serves as a model for future water settlements. The success of Indian water settlements in the United States has the potential, under the right political and legal conditions, to be replicated in other areas of the world where water resources are under dispute and water rights have come into conflict between indigenous and non-indigenous users.

Health-seeking behaviors are influenced by multiple factors including an assessment of the symptoms, what degree of personal commitment is involved in treatment, and what, if any, alternative methods of treatment are available. In the case of infertility, seeking treatment is likely to occur after the inability to get pregnant or carry a pregnancy to term persists for longer then a year or more. This is after prolonged exposure to the risk of pregnancy fails to provide a successful pregnancy, and the desire for children remains. Most research on health-seeking behaviors for infertility focus on the nulliparous woman who is at risk of primary infertility. This research furthers this examination by comparing the rates of health-seeking behaviors for women at risk of primary infertility to women at risk of secondary infertility. A woman at risk of primary infertility is identified as nulliparous in that she has never been pregnant, or has never had a pregnancy end in live birth. A woman at risk of secondary infertility is identified as parous and has already had one pregnancy end in live birth. Using three pathways that include social factors, biological mechanisms, and contextual effects, I hypothesize that the rates of health-seeking behaviors will vary by infertility risk and that women at risk of primary infertility will have higher rates of health-seeking behaviors for infertility. These hypotheses are based on the Behavioral Model of Health Services Utilization and the Health Belief Model that states health-seeking behaviors are influenced by the presence of enabling and predisposing factors, combined with internal and external cues. Findings from this dissertation suggest that the rates of health-seeking behaviors do indeed vary by infertility risk.

Social learning theory has enjoyed decades of supportive research and has been applied to a wide range of criminal and deviant behavior. Still eluding criminological theorists, however, is a meaningful understanding of the causal processes underlying social learning. This lack of knowledge is due in part to a relative reluctance to examine value transmission as a process in the contexts of mentorship, role modeling, and social learning. With this empirical gap in mind, the present study seeks to isolate and classify meaningful themes in mentorship through loosely structured interviews with young men on the periphery of the criminal processing system. The purposive sample is drawn from youth in a Southwestern state, living in a state-funded, privately run group home for children of unfit, incarcerated, or deported/undocumented parents. The youth included in the study have recently passed the age of eighteen, and have elected to stay in the group home on a voluntary basis pending the completion of a High School diploma. Further, both the subjects and the researcher participate in a program which imparts mentorship through art projects, free expression, and ongoing, semi-structured exposure to prosocial adults. This study therefore provides a unique opportunity to explore qualitatively social learning concepts through the eyes of troubled youth, and to generate new lines of theory to facilitate the empirical testing of social learning as a process. Implications for future research are discussed.

People going through homelessness in the contemporary U.S. struggle with a number of dehumanizing challenges. Even as some attempt to secure employment and end their homelessness, they may run into difficulties because they have been Othered to such a significant level. They have effectively been left out of society because of their lack of participation in its dominant activity as prescribed by market fundamentalism, the creation and exchange of goods. The following thesis seeks to explore the experience of homelessness for those within a homeless shelter environment in an economic-focused society. It utilizes Midrash Social Research Methodology (MSRM) to focus on the voice of the person going through homelessness, the marginalized Other. It relies on the phenomenology of the 20th-Century philosopher Emmanuel Levinas in an effort to explore the meaning and knowledge to be found in conversations held with the Other. The goal of this thesis is to propose a purposeful refocusing on service through conversation. The issue of homelessness is multi-faceted and its causes are as diverse as the people who experience it. Service providers in particular must engage those being Othered, and they must provide support in ways that allow for pluralistic realities, not prescribing singular means of ending homelessness.

Above all else, this project is about parentage in the modern American legal system and culture. Advanced reproductive technologies require our courts to reconsider the long-standing presumption that a child has only one female mother and one male father. We now have children of choice, rather than chance. Assisted Reproductive Technology and its widespread availability and use and changed the landscape of parentage maybe forever. And the children of such efforts remain largely unprotected by our current legal system that favors reproduction by chance within a recognized marriage or at the least, a traditional two-parent paradigm. However, assisted reproduction calls into question the current legal framework for determinations of parentage based in marriage and/or biology. Based on a long and convoluted history, our current legal system conflates marriage and parentage. Moreover, in many circumstances the law restricts both the number and gender of the parties to a marriage or possible parents. One of the more compelling historical and still salient justifications for doing so is to accord the "Best Interest of the Child" standard which purports to underpin all such determinations. Unfortunately, that standard cannot best be met when weighed in a balance against a constitutionally protected exclusive right to parent vested in an adult either by a determination of a genetic link to the child or marriage to another parent. Children of choice, who result from the affirmative and purposive engagement in assisted reproduction, should be entitled to the same protections as children of chance born to a man and woman who are married. Once we look beyond marriage and biology as determiners of parentage, a better way for our legal system to serve the best interests of children, and their parents, is to identify and protect those adult relationships that are parental in nature and that benefit the child irrespective of a marriage between parents or genetic links to the child. Fortunately, the tools to accomplish this paradigm shift already are in existence. The expansion of our commonly used definitions and broader view of our current statutes will allow the legal system to better protect both children of choice and children of chance by making better parentage determinations. To that end, this project also takes on the ambitious task of praxis; of applying the theories to the law as it stands and demonstrating how the new paradigm might look as it is implemented with all of its far-reaching tentacles.

ABSTRACT There is a body of literature--albeit largely from the UK and Australia--that examines the ways in which class and gender influence life course, including educational attainment; however, much of this literature offers explanations and analyses for why individuals choose the life course they do. By assuming a cause-effect relationship between class and gender and life course, these studies perpetuate the idea that life can be predicted and controlled. Such an approach implies there is but one way of viewing--or an "official reading" of--the experience of class and gender. This silences other readings. This study goes beneath these "interpretations" and explores the phenomenon of identity and identity making in women who grew up working-class. Included is an investigation into how these women recognize and participate in their own identity making, identifying the interpretations they created and apply to their experience and the ways in which they juxtapose their educative experience. Using semi-structured interview I interviewed 21 women with working-class habitués. The strategy of inquiry that corresponded best to the goal of this project was heuristics, a variant of empathetic phenomenology. Heuristics distinguishes itself by including the life experience of the researcher while still showing how different people may participate in an event in their lives and how these individuals may give it radically different meanings. This has two effects: (1) the researcher recognizes that their own life experience affects their interpretations of these stories and (2) it elucidates the researcher's own life as it relates to identity formation and educational experience. Two, heuristics encourages different ways of presenting findings through a variety of art forms meant to enhance the immediacy and impact of an experience rather than offer any explanation of it. As a result of the research, four themes essential to locating the experience of women who grew up working class were discovered: making, paying attention, taking care, and up. These themes have pedagogic significance as women with working-class habitués navigate from this social space: the downstream effect of which is how and what these women take up as education.

United States and Mexico population statistics show clear evidence of return migration. This study uses qualitative data collected in a municipality in the State of Mexico during the summer of 2010 from families comprised of Mexican nationals and United States-born children post-relocation to Mexico. Using Portes and Zhou's theoretical framework on modes of incorporation, this study illustrates the government policy, societal reception and coethnic community challenges the first and second generation face in their cases of family return migration. This study finds that the municipal government is indifferent to foreign children and their incorporation in Mexico schools. Furthermore, extended family and community, may not always aid the household's adaptation to Mexico. Despite the lack of a coethnic community, parents eventually acclimate into manual and entrepreneurial positions in society and the children contend to find a place called home.

This dissertation examines associations between religious affiliation, religious community context and health of women and their children in Mozambique focusing on the following issues: (1) attending prenatal consultations and delivering children in a health facility; (2) women's symptoms of STDs; and (3) under-five mortality. Estimation of random intercept Poisson regression for the outcome about attending prenatal consultations demonstrated a favorable effect of affiliation to Catholic or Mainline Protestant and Apostolic religious groups. The concentration of Zionist churches in the community had a negative influence. Random intercept logistic regression was used to estimate the relationship between religion and institutional child delivery. Affiliation to Catholic or Mainline Protestant denominations as well as concentration of Catholic or Mainline Protestant churches in the community had some beneficial effect on giving birth in health clinics. The presence of Zionist churches in the community had some negative effect and that of other groups no significant influence. Random intercept logistic regression was also employed for investigating the influence of religion on women's symptoms of STDs. Belonging to the Catholic or Mainline Protestant church had some protective effect on reporting symptoms of STDs. There was no effect of religious context, except that the concentration of Other Pentecostal churches had a positive effect on reporting symptoms of SDTs. Event-history analysis was conducted for examining relationships between maternal religious affiliation with under-five mortality. Affiliation to Catholic or Mainline Protestant churches and to Apostolic denominations increased the odds of child survival, although, the influence of having a mother belonging to Catholic or Mainline Protestant churches lost statistical significance after accounting particularly for the average level of education in the community, for the period of 5 years preceding the survey date. Taken together, the results in this dissertation show some protective effect of religion that varies primarily by denominational group to which women are affiliated. They also indicate that religious community context may have some negative effect on health of women and children. The nature of the effect of religious community context varies with the type of outcome considered and the type of religious mixture in the community.
